4. Ownership and Intellectual Property
Unless expressly stated otherwise, GRREM digital products and their original content are owned by or licensed to GRREM Education Services & Management Consultancy Ltd and are protected by applicable intellectual-property law.
Purchase or download of a GRREM digital product does not transfer ownership of the intellectual property to the purchaser.
Instead, the purchaser receives permission to use the resource in accordance with the licence set out in these Terms or any different licence expressly supplied with the product.
All rights not expressly granted are reserved.
5. Individual-User Licence
Unless a different licence is expressly stated on the relevant product page or agreed by GRREM in writing, purchase of a GRREM digital product provides the purchaser with a:
limited, non-exclusive, non-transferable licence for the purchaser's own personal professional-development use.
Under an individual-user licence, the purchaser may:
- download the resource to their own devices;
- retain a reasonable backup copy;
- print reasonable copies for their own use;
- complete worksheets, planners or reflective activities for their own professional development;
- use the resource to support their own learning and EPA preparation where applicable; and
- refer to the resource during their own professional-development activities.
The licence does not transfer copyright or other intellectual-property ownership.
6. What You Must Not Do
Unless GRREM has provided written permission or an appropriate organisational or multi-user licence, you must not:
- sell or resell a GRREM digital product;
- redistribute the complete product to another person;
- share an individual-user copy with colleagues, learners or staff cohorts;
- upload the product to a shared drive for multiple users;
- upload the product to an organisational intranet or learning-management system for multiple users;
- publish the product on a website or social-media platform;
- make the product publicly downloadable;
- reproduce substantial parts of the product for distribution;
- remove GRREM copyright, branding or ownership notices;
- represent GRREM materials as your own original work;
- commercially exploit the product outside the licence granted;
- substantially copy or adapt a GRREM resource for resale or redistribution; or
- use an individual-user licence to deliver the resource to a group or organisation where a multi-user or organisational licence would reasonably be required.
These restrictions do not prevent any use that cannot lawfully be restricted under applicable law.
7. Organisational and Multi-User Use
Care providers, training organisations, employers, educational organisations or other organisations wishing to use GRREM resources with multiple staff members or learners should contact GRREM regarding an appropriate organisational or multi-user licence.
This may include use:
- across a staff team;
- with an apprentice cohort;
- within an internal training programme;
- on an organisational learning platform;
- as part of structured workforce development; or
- across multiple services or locations.
For organisational licensing enquiries, contact:
info@grremeducation.co.uk
Unless expressly agreed otherwise, purchasing one individual copy does not create an organisation-wide licence.
8. EPA Preparation Resources
Some GRREM digital products are designed to support apprentices preparing for End-Point Assessment, including the Level 5 Leader in Adult Care apprenticeship.
GRREM provides independent preparation and professional-development support.
GRREM is not an End-Point Assessment Organisation and does not conduct or award End-Point Assessment.
EPA requirements, assessment plans and apprenticeship standards may change.
Users are responsible for confirming the version of the apprenticeship standard and assessment plan applicable to them.
GRREM resources do not replace instructions provided by:
- the apprentice's employer;
- training provider;
- End-Point Assessment Organisation;
- assessor; or
- the applicable official apprenticeship documentation.
Where there is any difference between a GRREM resource and the official requirements applicable to an apprentice's assessment, the applicable official requirements take precedence.
9. Authenticity of EPA Evidence
GRREM EPA resources are designed to help apprentices understand requirements, structure reflection, identify appropriate evidence and prepare for assessment.
They must not be used to misrepresent another person's work or experience as the apprentice's own.
Apprentices remain responsible for ensuring that examples, evidence, accounts of workplace practice and professional reflections presented during EPA are genuine and appropriately reflect their own experience.
Templates, frameworks and model structures provided by GRREM are learning and preparation tools and should be adapted appropriately to the user's genuine circumstances.
10. No Guaranteed EPA Outcome
Purchase or use of a GRREM EPA resource does not guarantee:
- successful completion of EPA;
- a particular EPA grade;
- distinction;
- acceptance of particular evidence;
- a particular assessment decision; or
- any other academic, professional or employment outcome.
Assessment decisions remain the responsibility of the relevant authorised assessment organisation and its assessors.
11. Product Descriptions
GRREM will take reasonable care to describe digital products accurately.
Before purchasing, customers should review the product description to understand what is included, the intended audience, format and any relevant requirements.
Images, mock-ups or examples may sometimes be used to demonstrate how a resource looks or may be used.
Where a product description specifies particular files, pages, templates or other content, that description forms part of the information on which the purchase is made.
12. Prices and Payment
Where a digital product is offered for sale, the applicable price will be displayed before purchase.
Customers will be informed of the total amount payable before completing the transaction.
GRREM is not currently VAT registered. Where the business's VAT status changes or tax is otherwise required, website and checkout information will be updated as appropriate.
Payments may be processed through a third-party payment provider. GRREM does not need to receive or store complete payment-card details where those details are processed securely by the payment provider.
13. Digital Delivery
Digital products may be supplied by:
- immediate download;
- download link;
- customer account;
- email;
- another electronic delivery method identified at purchase; or
- a combination of these methods.
Customers are responsible for providing an accurate email address and maintaining reasonable access to the device, software and internet connection needed to access the product.
Where a download link expires or a genuine technical problem prevents access, customers should contact:
info@grremeducation.co.uk
GRREM will take reasonable steps to investigate legitimate access problems.
14. Cancellation Rights for Immediately Supplied Digital Content
Different cancellation rules may apply to digital content supplied online.
Where a consumer requests access to paid digital content during an applicable statutory cancellation period, GRREM will obtain any consent and acknowledgement required by law before beginning immediate digital supply.
Where required, the checkout process will ask the consumer to:
- expressly agree that supply of the digital content may begin immediately; and
- acknowledge that, once supply begins in accordance with the applicable legal requirements, the consumer will lose the applicable statutory right to cancel that digital-content contract.
The required consent and acknowledgement must be obtained through the purchase process where applicable. Merely including this information in these Digital Product Terms is not intended to replace any separate action required from the consumer.
The customer will also receive the applicable contractual information in a form they can retain where required by law.
If GRREM does not obtain the consent, acknowledgement or confirmation required by applicable law, the consumer's statutory rights will remain unaffected.
15. Faulty, Misdescribed or Inaccessible Digital Content
Nothing in these Terms removes a consumer's statutory rights concerning digital content.
Digital content supplied to consumers must meet applicable legal requirements.
If a purchased GRREM digital product is:
- materially different from its description;
- corrupted;
- genuinely inaccessible because of a problem with the supplied file; or
- otherwise fails to meet applicable statutory requirements,
please contact info@grremeducation.co.uk with details of the problem.
Where appropriate, GRREM may investigate and provide a replacement, correction, restored access, price reduction, refund or another remedy required or permitted by applicable law.
16. Change of Mind
Where a statutory cancellation right still applies, GRREM will respect that right in accordance with applicable law.
Where a consumer has expressly requested immediate supply of digital content and has provided the legally required acknowledgement concerning loss of the cancellation right, the right to cancel may be lost once supply begins in accordance with applicable law.
This does not affect rights relating to faulty, misdescribed or otherwise non-conforming digital content.
17. Free Digital Resources
GRREM may make some digital resources available free of charge.
Unless otherwise stated, free resources remain protected by GRREM's intellectual-property rights and are provided under the same individual-use principles set out in these Terms.
Making a resource available free of charge does not place it in the public domain or automatically grant permission for commercial redistribution.
18. Updates to Digital Products
GRREM may update digital products from time to time to improve content, correct errors, reflect professional developments or respond to changes in relevant requirements.
Unless expressly stated otherwise at the time of purchase, purchasing a digital product does not automatically entitle the purchaser to every future edition, substantially revised version or replacement product.
Where an update is included with a purchase, this will be stated where appropriate.
Users of EPA and regulatory-related resources should check that the edition they are using remains appropriate to the requirements applicable to them.
19. Third-Party References and Official Materials
GRREM resources may refer to legislation, regulatory information, apprenticeship standards, government publications or other third-party materials.
Ownership of third-party material remains with the relevant rights holder.
A reference to a third-party organisation or publication does not imply endorsement of GRREM by that organisation unless expressly stated.
Users should consult current official sources where up-to-date regulatory or assessment requirements are important.
20. Educational and Professional-Development Purpose
GRREM digital resources are designed for educational and professional-development purposes.
They are not a substitute for organisation-specific legal, regulatory, clinical or financial advice.
Users and organisations remain responsible for decisions concerning their own practice, compliance, workforce and operations.
21. Limitation of Liability
Nothing in these Digital Product Terms excludes or limits liability where it would be unlawful to do so.
Nothing in these Terms removes statutory consumer rights.
Subject to applicable law, GRREM is not responsible for outcomes resulting from:
- misuse of a resource;
- unauthorised modification or redistribution;
- reliance on an outdated edition where the user knew or reasonably should have known that applicable requirements had changed;
- failure to follow applicable official assessment or regulatory requirements; or
- use of a resource for a purpose for which it was not designed.
22. Suspension or Termination of Licence
Where a user materially breaches the licence conditions in these Terms, GRREM may take reasonable steps to protect its intellectual property and, where legally permitted, terminate or restrict the licence or access concerned.
Examples may include deliberate unauthorised resale, systematic redistribution or publication of protected GRREM resources.
Any action taken will be subject to applicable law and will not affect rights that cannot legally be excluded.
23. Privacy
Personal information associated with orders, enquiries and digital-product delivery will be handled in accordance with GRREM's Privacy Policy.
Information about website cookies and similar technologies is available in our Cookie Policy.
24. Changes to These Terms
GRREM may update these Digital Product Terms from time to time.
The version applicable to a purchase will normally be the version presented or otherwise applicable when the contract is entered into, subject to any changes required by law or expressly agreed with the customer.
The latest general version will be displayed on the GRREM website with its revision date.
25. Governing Law and Consumer Rights
These Digital Product Terms are governed by the laws of England and Wales.
If you are a consumer, you may also benefit from mandatory consumer protections applicable where you live. Nothing in these Terms is intended to remove rights that cannot legally be excluded or restricted.
